These Terms govern your use of estevanenotaryservices.com and your engagement of services from Estevane Notary Services LC (“we,” “us,” “our”). By using this site, booking services, or participating in any contest or promotion, you agree to these Terms.
Services Provided
We offer in-office notary services at our Weslaco, TX location and Remote Online Notarization (RON) where permitted by law. Appointments are required for all services.
No Legal Advice
We are not attorneys and do not provide legal advice or select legal forms. Our services are limited to verifying identity and witnessing signatures as permitted under Texas notary law. Any information on this site is provided for general informational purposes only.
Identification & Signer Requirements
- Each signer must present valid, government-issued photo identification.
- Documents must remain unsigned until instructed by the notary.
- The signer must be able to communicate in English or provide a qualified interpreter.
Appointments, Cancellations & No-Shows
Appointments must be scheduled in advance. Arriving late or missing an appointment without notice may result in a cancellation fee. Changes or cancellations require at least 24 hours’ notice.
Fees & Payment
- Notarial fees comply with Texas law (e.g., $10 per traditional act; $25 per RON).
- Additional service charges (after-hours, scanning, printing, travel, or mileage) may apply and will be disclosed before payment.
- Payment is due at the time of service unless other arrangements are made. All sales are final once the notarization is complete.
Remote Online Notarization (RON)
RON is performed using a secure third-party platform that manages identity verification, document handling, and audio/video recording. You must meet all technical and legal requirements to participate. We are not responsible for internet failures, software malfunctions, or rejected recordings caused by factors beyond our control.
Client Responsibilities
- Ensure all signers are present, prepared, and possess valid ID.
- Confirm that your receiving party accepts notarized documents in your chosen format.
- Arrive on time with all required paperwork and payment.
Refusal of Service
We may refuse or discontinue service if identification is invalid, fraud is suspected, the signer appears unaware or unwilling, or if conditions are unsafe or non-compliant with Texas law.
Contests & Promotions
Any contests or promotions we host, including the Halloween Costume Contest, are governed by separate Official Contest Rules. Entry fees are non-refundable. We are not liable for lost entries, technical issues, or unreceived submissions. By participating, entrants release Estevane Notary Services LC and its agents from all liability arising from participation or prize use.
Intellectual Property & Media Use
All logos, website content, photos, and graphics are owned or licensed by us. Contest entrants grant us a perpetual, royalty-free license to use their submitted photos, name, and likeness for promotional or contest purposes on our website and social media. No additional compensation will be provided.
Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim related to services or contest participation will not exceed the amount you paid to us for the specific service or entry fee. We are not responsible for incidental, indirect, special, or consequential damages, including lost profits or data.
Indemnification
You agree to indemnify and hold harmless Estevane Notary Services LC, its owners, employees, and affiliates from any claim, demand, or loss (including attorneys’ fees) arising out of your use of our services, your contest participation, or your breach of these Terms.
Arbitration Agreement
Any dispute or claim relating to these Terms or your use of our services shall be resolved by binding arbitration in Hidalgo County, Texas, under the rules of the American Arbitration Association. You waive the right to participate in class or representative actions. Small-claims disputes may be brought in Hidalgo County Justice Court.
Privacy
Your use of this site is also governed by our Privacy Policy. Contest entrants should also review our Contest Privacy Addendum.
Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to conflicts of law. The proper venue for any permitted dispute is Hidalgo County, Texas.
Changes
We may modify these Terms at any time. The updated version will be posted to this page with a new effective date. Continued use of our website constitutes acceptance of any revised terms.
